1. Overview

fair-arc ("the Platform") operates skill-gated prize events called "Arcs." Participation requires passing a skill challenge. The Platform is not a lottery, sweepstakes, or game of chance. Selection is conducted via cryptographically secure, provably fair RNG. By using fair-arc you agree to these Terms.

2. Eligibility

fair-arc is open to legal residents of the United States who are at least 18 years of age (or the age of majority in their jurisdiction, whichever is greater). Employees, officers, and directors of fair-arc and their immediate family members are not eligible to participate.

fair-arc reserves the right to restrict access from any jurisdiction at any time, at its sole discretion.

3. Nature of the Platform

fair-arc is a skill-based membership platform. All participants must successfully complete a genuine skill challenge before entering any Arc. The outcome of each Arc is determined by a provably fair, cryptographically verifiable random selection process. fair-arc is NOT a lottery, raffle, sweepstakes, or game of chance as defined under any federal or state law. The skill challenge requirement is a material and substantive element of participation, not a formality.

4. Membership & Fees

A one-time $10 membership fee is required to participate. This fee is credited toward your first Arc entry and is not an additional charge beyond your first entry. Membership fees are non-refundable except as required by law.

There are no recurring subscription fees. You pay only when you enter an Arc.

5. Skill Challenge Requirement

Every Arc entry requires passing a skill challenge (Math, Trivia, or Word Puzzle). This is a genuine test of skill — not a trivial formality. Attempts to circumvent, automate, or cheat the skill challenge will result in permanent account termination and forfeiture of any credits or entries.

Rate limiting applies: excessive failed attempts will result in a temporary cooldown period.

6. Arc Entry & Selection

• Each Arc has exactly 10 slots. Slots are assigned sequentially.
• Multiple entries per Arc are permitted (subject to slot availability).
• When all 10 slots fill, a 2-minute countdown begins before live selection.
• Selection uses cryptographically secure RNG. The seed hash is published before selection and the seed is revealed after, allowing independent verification.
• If an Arc does not fill within 3 days, entrants may withdraw at no charge.

7. No Guarantee / Assumption of Risk

Participation in fair-arc does not guarantee any prize or return on entry fees. By participating, you acknowledge that entry fees are non-refundable (except as outlined in our refund policy) and that you participate at your own risk. fair-arc is not responsible for any losses incurred through participation.

8. Prizes & Fulfillment

Winners are notified by email and asked to confirm their shipping address. Prizes are shipped fully insured. If the stated prize becomes unavailable due to supply chain issues or other circumstances beyond our control, the winner will be offered a gift card of equivalent retail value.

Prizes are non-transferable and may not be exchanged for cash except at our sole discretion. Winners are responsible for any applicable taxes on prizes received.

9. Refunds

Entry fees are non-refundable once payment is confirmed, except: (a) if the Arc fails to fill within the 3-day window, or (b) as required by applicable law. Membership fees are non-refundable once credited toward an entry. Payment processing errors are handled on a case-by-case basis — contact support.

10. Prohibited Conduct

• Using automated bots, scripts, or AI tools to complete skill challenges.
• Creating multiple accounts to circumvent rate limits or entry restrictions.
• Attempting to manipulate, reverse-engineer, or interfere with the RNG or selection process.
• Fraudulent payment activity.
• Any conduct that undermines the fairness of the Platform for other participants.

11. Dispute Resolution

All Arc results are final and verifiable. Any disputes regarding the selection outcome may be resolved independently using the provably fair verification system — the seed, seed hash, and RNG sequence are publicly available for every completed Arc.

Any dispute arising from your use of fair-arc shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Texas. You agree to waive any right to a jury trial or participation in a class action lawsuit. For billing disputes or other concerns, contact us within 30 days of the event.

12. Limitation of Liability

fair-arc's total liability to any member shall not exceed the total amount of entry fees paid by that member in the 12 months preceding the claim.

fair-arc is not liable for any indirect, incidental, special, consequential, or punitive damages. The Platform is provided "as is" without warranty of any kind.

13. Modification of Terms

fair-arc reserves the right to modify these terms at any time. Continued use of the platform after modifications constitutes acceptance of the updated terms. Material changes will be communicated via email to registered members.
